These Terms of Service (“Terms”) govern your use of carjinga.com and related services (the “Site”), operated by CarJinga (“CarJinga,” “we,” “us”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

What CarJinga is

CarJinga is an online marketplace that helps people find used cars. Listings come from dealers' published inventory and from private sellers who post directly. CarJinga is not a dealer, broker, lender, or agent. We do not own, inspect, sell, or deliver any vehicle, and we are not a party to any sale between a buyer and a seller. Any transaction is solely between you and the seller.

Eligibility and accounts

• You must be at least 18 years old to create an account, post a listing, or contact a seller.
• Give accurate information and keep your password confidential. You are responsible for activity under your account.
• Tell us right away if you believe your account has been used without your permission.

Listing information, prices, and deal ratings

Vehicle details, prices, photos, mileage, and availability come from sellers and dealers and can change or be out of date at any time. We work to keep listings current but do not guarantee that any listing is accurate, complete, or still available. Always confirm the price, fees, condition, and availability directly with the seller before you rely on them, and have a vehicle inspected and review its history report before you buy.

Deal ratings, market-value estimates, and distance sorting are automated estimates based on comparable listings. They are for general information only. They are not an appraisal, valuation, or financial advice, and they do not guarantee that a car is a good purchase or worth any particular price.

Posting listings

If you post a car for sale, you promise that:

• You own the vehicle or have the legal right to sell it, and you may lawfully sell it where you offer it.
• Every statement in your listing is true, including price, mileage, condition, and title status, and you have disclosed known material defects.
• The photos are of the actual vehicle, and you own them or have permission to use them.
• The contact information you provide is real and reachable.

Listings expire 30 days after they are posted unless renewed. We may edit, remove, or refuse any listing at our discretion, including listings that appear inaccurate, duplicated, misleading, or unlawful.

Acceptable use

You agree not to:

• Post false, misleading, fraudulent, or illegal content, or list a vehicle you do not own.
• Use the Site to harass others, send spam, or send messages unrelated to a listing.
• Collect other users' information, or use automated tools to copy the Site's content at scale without our written permission.
• Interfere with or disrupt the Site, test its security without permission, or try to access accounts or data that are not yours.
• Use the Site in violation of any law or anyone's rights.

Your content

You keep ownership of the content you post (listings, photos, messages). By posting it, you give CarJinga a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content on and in connection with the Site and our marketing of it. You are responsible for your content and for having the rights to share it.

Our content and intellectual property

The Site's design, software, text, logos, and deal-rating methods belong to CarJinga or its licensors and are protected by law. You may use the Site for personal, non-commercial shopping and for listing your own vehicles. Dealer names, logos, and listing content remain the property of their respective owners.

Third-party sites and advertising

The Site may link to dealers' websites, history-report providers, and other third parties, and may display advertising. We do not control or endorse those sites or ads and are not responsible for them or for any dealings you have with them.

Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LISTING, PRICE, RATING, OR SELLER IS ACCURATE, RELIABLE, OR LAWFUL. WE MAKE NO WARRANTY ABOUT ANY VEHICLE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARJINGA AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY TRANSACTION OR DISPUTE BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limits, so some of these may not apply to you.

Indemnity

You agree to defend and hold harmless CarJinga from claims, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Site, or your violation of these Terms or of any law or third party's rights.

Suspension and termination

We may suspend or close your account or remove your content at any time, with or without notice, if we believe you have broken these Terms or put the Site or others at risk. You may stop using the Site and ask us to close your account at any time by emailing support@carjinga.com.

Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Continuing to use the Site after a change means you accept the updated Terms.
